A obrigação de cobrir tratamento ou procedimento solicitado por médicos conveniados deve prevalecer sobre a cláusula limitativa de direitos. Isso ocorre porque as cláusulas dos contratos de plano de saúde devem ser interpretadas em favor do consumidor, conforme prevê o artigo 47 do Código de Defesa do Consumidor. Essa é a argumentação central da decisão.
